The US Environmental Protection Agency (EPA) has ordered Inhance Technologies to stop producing three “forever chemicals” by the end of February 2024. These chemicals are generated during the manufacturing process for fluorinated HDPE. Inhance Technologies, a Houston-based company, has contested the EPA’s decision, which it considers to be a ban on producing containers.

The company has taken legal action by appealing to the US Fifth Circuit Court of Appeals in New Orleans to stop the “one-sided” order. If the regulatory action is allowed to take effect, Inhance Technologies will be forced to shut down its 11 barrier technology facilities across the US, causing disruption in downstream industries and related supply chains that rely on its “environmentally critical technology.”

The Texas-based producer claims that its proprietary technology can prevent more than 25,000 tons of chemicals from being released into the environment due to packaging permeation, protecting the environment by preventing the permeation of container contents (mostly through evaporative emissions).
