The Environmental Protection Agency must hand over previously withheld chemicals data after a court said its pledges to change disclosure practices were insufficient.
The US District Court for the District of Columbia ruled Tuesday the agency failed to immediately publish chemical manufacturer notices for testing and manufacturing and didn’t disclose all possible related health and safety information.
The Environmental Defense Fund and four other groups sued the agency in 2020, alleging the agency withheld new information about chemicals to which the public is legally entitled to under the Toxic Substances Control Act.
The suit carried over from the Trump administration after the groups alleged the Biden administration missed deadlines to post applications for chemical testing and manufacturing chemicals and published public health notices with missing information in the Federal Register.
